General Data Protection Regulations (GDPR)

General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) is a regulation by which the European Parliament, the Council of the European Union and the European Commission intend to strengthen and unify data protection for all individuals within the European Union (EU).  UK organisations (including landlords) will still need to be compliant after BREXIT.

GDPR is applicable to personal data held in any format digital or hard-copy (or other means) and will require that all landlords and agents are compliant.  The GDPR introduces greater legal rights on how personal data is obtained, used, stored and destroyed (such as tenant or landlord personal data). Non-compliance can lead to significant fines.

The regulation was adopted on 27 April 2016. It becomes enforceable from 25 May 2018 after a two-year transition period and, unlike a directive, it does not require national governments to pass any enabling legislation, and is thus directly binding and applicable.

ALL Wessex are currently seeking a GDPR course for our members that is specific to the private rented sector “letting process”, however, courses currently available are expensive, generic, aimed at large businesses and hence non-specific and more detailed than necessary. We will continue to search for a suitable course.

For now, please read this  and start applying the principles to your current work processes. Specific areas to be aware of are those relating to; recording consents (must be specific and signed for, i.e. not included as a tickbox or paragraph in an AST), right to erasure (requests for deletion/removal), use of data (details of data use must be specific and stated in a privacy notice).
